    AI, other education technology can infringe on rights of disabled, LGBTQ students, report warns

    The use of education technology in schools, such as artificial intelligence, digital surveillance and content filters, poses a threat to the civil rights of students with disabilities, LGBTQ students and students of color, a new report released Wednesday warns.

    Some technology used in schools to block explicit adult content and flag students at risk of self-harm or harming others have also created serious problems for already vulnerable students, cautions the report by the Center for Democracy and Technology, a nonprofit, nonpartisan organization that advocates for civil rights in the digital world.

    The report is based on a wide-ranging online national survey about the technology used by schools, students and teachers. This summer, the Center for Democracy and Technology polled 1,029 ninth- through 12th-grade students, 1,018 parents of sixth through 12th grade students and 1,005 teachers of sixth through 12th grade students in a sample the organization said was weighted to be “nationally representative.”

    According to the Center for Democracy and Technology, the surveys also indicate widespread confusion about the role of artificial intelligence in the classroom, with a majority of parents, students and teachers saying they want more information and training about how to properly use it.

    Report outlines education technology’s risks to students

    The report outlines how school technology can, often inadvertently, harm students. The Center for Democracy and Technology says these harms are felt most acutely by vulnerable students.

    Students reported incidents of LGBTQ classmates being outed by digital surveillance, a potentially traumatizing event of sharing their sexual identity or orientation without their consent.

    Students with disabilities said they were most likely to use artificial intelligence — and they were more likely to report facing disciplinary action for using it.

    One-third of teachers said content related to race or the LGBTQ community is more likely to be restricted by filters. The center said this “amounts to a digital book ban.”

    Some schools have faced pushback for the way they deployed technology. After the American Civil Liberties Union sued a school district in Texas, the district loosened a filter that had blocked the website of the Trevor Project, a website aimed at LGBTQ youth.

    “There are certain groups of students who should already be protected by existing civil rights laws, and yet they are still experiencing disproportionate and negative consequences because of the use of this education data and technology,” said Elizabeth Laird, director of equity in civic technology for the Center for Democracy and Technology.

    Although schools often have dedicated staff and other practices set up to ensure that students’ civil rights are being protected, Laird said its survey indicates that schools have not fully wrestled with how education technology is affecting the promise of an equitable education, resulting in civil rights and technology being treated as separate issues.

    “I think they’ve been kept separate, and the time is now to bring those together,” Laird said.

    Civil rights groups call for more federal guidance

    While schools have been conducting more outreach than in previous years, the survey shows an increase in student and parent concerns about data and privacy over the past year. Survey data collected in previous years shows both parents and students need more outreach and engagement on how schools are selecting and using technology.

    Last October, the White House released a Blueprint for an AI Bill of Rights, but civil rights groups — including the ACLU, the American Association of School Librarians, American Library Association, Disability Rights in Education Defense Fund and the Electronic Frontier Foundation — signed a letter accompanying the Center for Democracy and Technology’s report, petitioning the federal Department of Education for more guidance.

    “In the year since the release of the Blueprint, the need for education-related protections remains and, if anything, is even more urgent with the explosive emergence of generative AI,” according to the letter.

    Fifty-seven percent of teachers in the survey stated they haven’t had any substantive training in AI, while 24% say they have received training in how to detect inappropriate use of AI.

    The survey also found that 58% of students have used ChatGPT or other generative AI programs, and 19% said they have submitted a paper written using AI. Students report using AI both for school assignments and for dealing with mental health issues or personal problems with family and friends.

    Students with disabilities are more likely to use generative AI: 72% said they’ve used the technology. Parents of students with disabilities are more likely to say that their students have been disciplined for their use of artificial intelligence. The report calls higher rates of discipline among vulnerable communities “particularly worrisome.”

    These students and their parents — 71% of students with disabilities and 79% of their parents — express more concern than others about the privacy and security of the data collected and stored by the school.

    Licensed special education teachers are more likely to have conversations with students and their parents about student privacy and equity issues in technology, a “promising practice that could be extended to the rest of the school population,” the Center for Democracy and Technology recommends.

    School surveillance’s long arm

    The civil rights issues can go beyond the walls of the school. Some students, particularly students of color and those from lower-income communities are more likely to rely on school-issued devices when they are at home. Monitoring and tracking can therefore follow them home.

    “Their learning environment for those students is quite different than those who can essentially opt out of some of this tracking,” Laird said.

    Students who use technology devices to charge their personal phones may also find that this technology will scan and monitor these personal devices as well. Among students who have used their school device for charging, 51% said school software began syncing with and downloading content from their personal device.

    Monitoring technology became prevalent in the pandemic-era remote learning, but it has persisted, with 88% of teachers reporting their schools use the technology. The White House named preventing the unchecked monitoring of students a priority in its blueprint. The Center for Democracy and Technology says that the use of surveillance technology can cause a host of problems for students.

    Students with disabilities and LGBTQ students are more likely to report being disciplined as a result of technology that monitors them. Laird said that sometimes students are disciplined for something the technology flagged, but other times, they are disciplined because of their reaction to being flagged.

    Schools sometimes share data directly with law enforcement — even after school hours. Fifty-three percent of special education teachers and 46% of teachers in Title I schools said data was shared with law enforcement after hours. During an interview with the Center for Democracy and Technology, the parent of a ninth grader said that law enforcement was contacted even before she was notified when something on her child’s device was flagged by the school’s monitoring technology. Her son was questioned for an hour without her consent.

    “All of those things can result in students being removed from the classroom and losing instructional time,” said Laird. “And so if those students are being disproportionately flagged and being intervened in a disproportionate way, this could also be a potential violation of [a student’s right to a free and appropriate public education], which is specific to preventing discrimination on the basis of disability.”

    Gov. Gavin Newsom’s proposed “Career Passport” aims to streamline job seekers’ credentials into a digital portfolio, making it easier for employers to recognize individuals’ skills and experiences.

    While the concept may seem promising, the reality is that learning employment records (LERs) — the foundation of the Career Passport — are still in the early stages of development and adoption. Few employers and job seekers currently use them, and the technology remains largely unknown and untested.

    Before the government spends $100 million in taxpayer dollars on technology that lacks meaningful adoption and trust, the focus should be on allowing innovators to first develop LER technology that is valid, reliable and useful for both employers and job seekers.

    The Career Passport is not the state’s first attempt at a large-scale education and workforce data initiative. The Cradle-to-Career (C2C) data system, which was supposed to create a seamless record of Californians’ educational and career progress, remains years behind schedule and is still largely theoretical. Furthermore, the effort is a prime example of the state’s poor track record in this space. C2C marketed itself as a system that would stitch together “data from multiple education systems” only to deliver none of that to date. If the state cannot successfully deliver on even the first leg of the C2C system, why should we expect better results from a Career Passport? Rather than spreading thin, already dwindling resources and distracting an overburdened state workforce with another massive set of promises, the state should focus on completing the work it has already spent money on and not yet delivered.

    Before attempting to implement the Career Passport, California should wait until the innovation sector has figured out how to make learning employment records that work at scale, demonstrate real value in the hiring process and earn buy-in from employers and job seekers. Pouring state funds into largely experimental technology at this point risks wasting taxpayer money during a $68 billion budget deficit.

    Moreover, the state government is the wrong entity to drive innovation at this stage. The bureaucratic inefficiencies associated with public-sector initiatives — lengthy procurement processes, cumbersome regulations, and political red tape — will not ensure success. Instead, the state’s involvement will disrupt and possibly undermine existing voluntary collaborations already making headway in developing learning employment records and similar technology. The state’s proposal to put itself as the driver of this work risks turning what is currently a collaborative ecosystem, into a competitive battle for state dollars, stifling innovation rather than fostering it.

    California should allow the innovation sector to do what it does best — collaborate, experiment and refine solutions until they are proven effective. What needs to happen — and is already happening — is that learning employment records companies, educational institutions, employers, and other innovators are working together to figure out how to develop and refine these technologies in ways that employers and learners trust, which will lead to adoption. This process of collaboration and iteration is essential to ensuring that they become a useful and reliable tool in the job market.

    Government intervention at this stage, particularly a massive infusion of public funds, risks disrupting collaboration, creating unnecessary noise and slowing down true innovation. During this crucial innovation phase, the government needs to stay out of the way and allow the private and nonprofit sectors to innovate freely. Only after learning employment records have demonstrated their value and reliability in effectively matching talent to jobs, should the state consider spending money on their widespread adoption.

    If Gov. Newsom genuinely wants to improve how Californians translate their education and experiences into career opportunities, he should wait until the technology is ready rather than disrupting innovation and placing a massive bet on an experiment. And, he should recognize that it is far too early to invest state dollars in such a venture.

    Job hunting may be awful, but California’s employers and job seekers deserve better than just another set of unfulfilled promises.

    How Covid changed teaching in California: fewer pencils, more technology


    The Covid-19 pandemic has significantly changed how students and teachers spend their time in the classroom. Now, instead of writing with paper and pencil, students use computers for most assignments.

    Teachers lecture less and spend more time on individualized instruction, social-emotional learning and relationship building.

    The last five years have not been easy. Students returned to campuses in the spring of 2021, after spending more than a year learning alone from home on computers. They had knowledge gaps, and many felt isolated and unsure, often resulting in chronic absenteeism and bad behavior. 

    Thousands of California teachers, discouraged by disciplinary problems, quit the profession.

    But others doubled down on individualized instruction and social-emotional support, spending a good portion of class time reacquainting their students with how to behave in the classroom and encouraging them to socialize with their peers.

    Now, five years after Covid closed schools, student scores on the state’s standardized Smarter Balanced tests have improved slightly, although achievement is still not back to pre-Covid levels. 

    California teachers interviewed by EdSource are optimistic, reporting that interventions are working and that student discipline is improving.

    “They don’t miss their houses,”  said Erika Cedeno, who teaches Spanish at Golden Valley High School in Santa Clarita. “They don’t miss anything related to Covid. They want to be at school, and they are enjoying sports. They are playing tennis and swimming. It’s very different. I think we are probably getting to the point that we were before Covid.”

    More personalized learning

    Teachers report placing a greater emphasis on small-group instruction and personalized learning to accommodate students who returned from school closures with diverse learning needs, according to “Rewiring the classroom: How the Covid-19 pandemic transformed K-12 education,” released in August by the Brookings Institution. 

    The spring 2023 survey of 1,000 K-12 teachers and administrators across the country revealed that students now spend less time in lectures and more time working on educational software tailored to their needs. The increased use of technology by students, teachers and parents is the biggest change in the classroom since Covid-19 closures, said Brian Jacob, who co-authored the Brookings report. 

    After months of working on educational software during pandemic school closures, teachers are now more likely to incorporate it into their classrooms, according to the report. In early 2023, 70% of all students and 80% of all middle and high school students in the United States had a personal computing device.

    “I use technology more freely in the classroom now, and it’s an expected part of the day,” Todd Shadbourne, a sixth grade teacher at Foulks Ranch Elementary School in Elk Grove, told EdSource. 

    “We used to do a research project and everybody had to go to the library and get a book, and hope they could get a book,” Shadbourne said. “And we couldn’t study biographies when my neighboring class was doing biographies because there’s only so many books. … Now you have other resources because you have a computer in front of you.”

    Too much technology isn’t good

    There are some drawbacks to the increased use of technology in schools, however. Research shows that reading comprehension is better when students read printed texts instead of online materials, Jacob said. Students also struggle with writing and spelling because all their school work is done on computers equipped with programs that correct spelling and grammar, he said.

    “School officials and researchers really need to look at that carefully and determine how much time students are spending on devices, and how is that going?” Jacob said.

    Some California teachers try to limit their students’ screen time and require them to spend more time reading text, writing with pencil and paper and collaborating with their classmates.

    San Diego special education teacher Carly Bresee says the use of technology by students outside the classroom has also increased, prompting her to use less technology in class than before the pandemic.

    “I know that general ed teachers are kind of facing that question,” Bresee said. “How much computer use is healthy and positive for the students? They are having difficulty with that balance, knowing what the best formula is for learning.”

    Back to classroom carts at some schools

    School officials at James Lick Middle School have decided to go back to classroom computer carts because the school, in financially strapped San Francisco Unified, could no longer afford to maintain and replace student computers that are broken, lost or outdated.

    “Kids have broken them on purpose,” said Keith Carames, who teaches theater arts and English at the school. “Kids have lost them. Kids have dropped them.”

    That move away from technology is a big disappointment to Carames, who became a convert after spending three months learning how to use Zoom, Google Classroom and other online education programs. 

    “I saw the light,” Carames said. “I can edit stuff online with them (the students). I can post videos. I have resources that are accessible. If they are absent, they can get work. There are letters that you can send to the family and newsletters and interactive things. It changed my practice as an educator. ”

    Carames calls the transition back to paper and pen “a nightmare.”

    “There are some kids who don’t even know how to spell their own first name,” he said.

    Changing views on school attendance

    The biggest change for Elk Grove’s Shadbourne since Covid is the perception among some students and parents that attending school is optional. Students go on vacation during the school year or decide to work from home on a given day because they think they can get assignments on Google Classroom and email them to the teacher.

    “And the social benefits of school, and the problem-solving that we do as a group, and the common culture we hope to create, it’s hard to do that when people are gone,” Shadbourne said. 

    The impact of absences is amplified in special education, where a student might make progress one day, miss a day of school, and lose that progress, Bresee said.

    Students need social-emotional support

    Since schools reopened in 2020, California teachers have been spending more time greeting their students at the door, sending them notes and planning activities that encourage communication and help build relationships. Making these connections helps students develop social-emotional skills and encourages them to come to school.

    “In special education, we saw a huge increase in maladaptive behaviors, and that was really difficult both for the students, the support staff and for teachers,” said Bresee, a TK-1 special education teacher at Perkins K-8 School. “… It was hard to maintain a regular routine because it felt like we were more frequently in crisis mode.”

    Students, especially younger ones, had to learn how to play and communicate effectively with others. That meant more time was set aside for adult-facilitated playtime than before the pandemic, Bresee said.

    “It became, in my eyes, an even more important part of the day, right up there with our literacy and math lessons,” Breese said.

    The effort seems to be paying off. This year, student behavior has improved, and the class routine is back on track, according to Bresee.

    Social-emotional support and building connections between students and their teachers and classmates are equally important for older students.

    Cedeno greets her Spanish students at the door every day and then spends roughly seven minutes at the beginning of each class asking questions to draw students into conversations meant to help them connect with her and their classmates.

    “Cuál es tu color favorito (What is your favorite color)?” she asks one day. “Cuál es tu dulce favorito (What is your favorite candy)?” she asks on another day.

    Cedeno also invites students to have lunch in her classroom if they need a safe space to relax and a microwave to heat their food.

    “We are trying to rebuild this step by step,” Cedeno said. “We are not there yet. But I think we are going to get there if we put in a lot of effort, a lot of compassion and empathy, because these kids, they need this.”

    Teachers know that giving students more freedom — by enabling greater choice and agency — unlocks engagement and better outcomes. Decades of research backs this idea up. Still, there’s value to structure in a classroom.

    How then, can teachers balance maintaining a level of control that steers productive learning with giving students the freedom they need to thrive? Setting clear boundaries and leveraging technology effectively are the keys. 

    The Value of Limiting Choice

    Technology is often thought of as a tool that can help open more choice for students. Whether it’s choosing research topics that fit their interests, providing options to engage in educational content to meet different learning styles, or even giving students ways to master topics at their own pace.

    Research on choice, however, shows that too many options can be counterproductive. People are more likely to make decisions, and avoid “analysis paralysis,” when there are fewer options. The magic number, the reports say, is to offer less than six choices. 

    As teachers continue to embrace allowing students more classroom freedom, using technology to offer a set of choices rather than limitless options can be effective. 

    Adding Alternatives for Answering Questions

    Class participation is an easy way to add greater freedom for students without overwhelming them with choices, especially by using technology. For example, if teachers want all students to participate in a classroom discussion they can ask for responses to questions using a computer-based poll and then ask students who feel comfortable to share their answers out loud.

    An alternative option is to adopt a platform with a classroom chat feature. Teachers who use classroom.cloud report that using the solution’s chat feature allows students who might be more self-conscious or shy to speak up. By typing their response, or even discreetly asking a question, students can engage more fully in classroom activities. 

    Adding Guardrails to Set Students Up for Success

    Many approaches that grant students greater freedoms are based on self-directed learning. Students might be able to choose the final format of a project or decide between learning about a topic by reading or watching a video about it.

    Likewise, offer a game like a web-based scavenger hunt. Such activities require students to use computers and tablets with internet access, opening the door to a variety of explorations, as well as distractions. 

    Just as teachers can use technology to increase options for learning, they can also use it to add guardrails that size down the vast world of the internet to something not quite so overwhelming (or tempting).

    Determining the websites and applications students can access by creating a list of “allowed” and “restricted” content ensures students only access relevant and appropriate resources during class. This way, they will stay on task and work more efficiently. 

    IT directors who have adopted classroom.cloud ease the burden of managing such a list off teachers’ plates. Instead of taking up teachers’ time to create and manage the lists, IT leaders work with educators to identify sites and apps and then set the restrictions and allowances. Other control options needed include different permissions for specific school buildings within a district. 

    Tools that enable simultaneous screen sharing as well as a lock screen feature can also help in setting up appropriate guardrails.

    When teachers can manage students’ screens with a single click, it becomes easier to bring everyone together after a period of working independently or redirect students who may have gone off track. 

    Provide Support Anytime, Anywhere

    Many classrooms have continued to embrace learn anytime, anywhere environments. Students are learning remotely, in person and in hybrid classrooms. No matter where kids are learning, they deserve the same level of help.

    The right technology can enable students to maintain freedom in where and how they learn while still getting the support they need. This goes beyond live-streamed instruction or watching videos asynchronously. Teachers can use technology, like classroom.cloud, to support and engage with students in the very moment they are learning.

    When teachers use technology they have an immense opportunity to continue fostering classroom environments that are engaging and anchored in choice. By considering how the same tools can create structure, educators can strike the balance to help students avoid feeling overwhelmed and keep them focused on growing and learning.
