    The day before final exams started at Granada High School in Livermore, special education teacher Laura Brown got word that a student’s father had been detained by immigration officers.

    Brown didn’t hesitate. She immediately called the student’s mother, Rosa Lopez, and went over to her house that night. She had known the family for 12 years, ever since the oldest son had been her student. The youngest, who just finished his sophomore year in high school, stops by her classroom regularly just to say hi.

    Together, Brown and Lopez wrote a message calling for help. Within hours, they had contacted their local congressional representative, mayor and local activists. Another teacher, Betsy Wilson, helped organize a rally to protest Miguel Angel Lopez’s detention. Days later, he was deported to Tijuana. As his wife travels to Mexico to help him, Brown and Wilson are still trying to support the family.

    “That’s the call of a teacher,” Brown said. “Your students need you and that’s it.”

    She would do the same for any student, she said.

    “Right now, if a student has anyone in their family that has an unknown legal status, it would be really hard for us to expect that their brains are going to be capable of learning and taking in content when they’re in such a traumatized and fearful state,” Brown said.

    SUPPORTING IMMIGRANT FAMILIES

    As U.S. Immigration and Customs Enforcement raids ramp up across California, so have reports of students grappling with trauma, upheaval and fear after family members — and sometimes students themselves — are detained.

    A fourth grader in Torrance and his father were sent to a detention center in Texas after an appointment with federal immigration officials on May 29. They were later deported to Honduras

    In San Francisco, at least 15 people, including four children, were detained by ICE at scheduled immigration check-ins on June 4, according to advocates. In May, a first grader in the district was deported with his mom to Nicaragua after attending an immigration appointment as part of their application for a visa. 

    “There was no chance for them to return home to get any of their belongings or to say goodbye,” said Maggie Furey, a social worker in the district. “The first grader left school Friday not knowing that they were never going to see their friends, teacher or community again.”

    Furey said the child’s deportation hit his classmates and teachers hard.

    “A lot of the adults were extremely distraught, and we saw heightened anxiety in our community because we have other families that have immigration appointments coming up and were really fearful,” Furey said. “The kids really missed the student, and you’re having to have really big conversations on a first-grade level with kids.”

    She said the child’s teacher set up an international video call so his classmates could say goodbye.

    In Los Angeles, dozens of people have been detained by ICE in recent days, and raids on businesses near schools have sparked fears that immigration agents may target graduation ceremonies. A Los Angeles Unified School District high school sophomore was detained last week, alongside her mother and sibling. She has since been sent to a detention center in Texas.  

    The effects on students extend beyond the communities where the most publicized raids have occurred. Efrain Tovar, who teaches English language development to English learners and immigrant students at Abraham Lincoln Middle School in Selma, in the Central Valley, said he’s seen an increase in fear and uncertainty.

    “We’ve had to call upon our therapists, our social workers at our school site to be able to have those heart-to-heart conversations with their students when they’re feeling anxious, stressed or very worried,” said Tovar. “It’s a reality that our students are facing, and students cannot learn when these types of events flare up in the classroom.”

    He said, in addition, many immigrant students are unsure of where they will be next school year, which makes it hard for them to plan for high school or the future.

    “There’s this feeling among the newcomers that ‘we don’t know if we’ll be back next year.’ As we end the school year, there’s a lot of what-ifs,” Tovar said. 

    Jesús Vedoya Rentería, who teaches English at Hanford West High School in the Central Valley, said in response to the fear among their peers, some of his students have decided to pass out “know-your-rights” cards outside Mexican markets or at the swap meet on weekends. He said it makes them feel more empowered.

    “They were concerned a lot of raids were going on and said we owed it to our immigrant population to make sure they’re informed,” Vedoya Rentería said.

    School staff are anxious to know what they can do to help students and families, said Ana Mendoza, director of education equity and senior staff attorney at ACLU of Southern California. She said the organization has worked with several school districts to provide presentations on students’ and families’ rights regarding immigration enforcement and training for school employees.

    “Schools have the obligation to ensure families know that students have the right to attend California public schools,” Mendoza said. 

    Federal law gives all children the right to a free public education, regardless of immigration status. Under California law, school districts must notify parents and guardians of that right. The state attorney general recommends that schools also work with parents to create a plan for who should have custody of the child if parents are detained, and that school staff connect families with legal help or other resources. 

    A family separated

    When Granada High School teachers stepped up to help Rosa Lopez, the mother in Livermore, it meant a lot, she said.

    “If it wasn’t for them, I would [have] probably be[en] home with my arms crossed just waiting for Miguel or the lawyer to call,” said Lopez. “That really motivated me and hyped me up, because I was like, ‘OK, I got this and I know I can do this, and we’re going to bring Miguel home.’”

    Lopez said her husband’s detention and deportation have deeply affected her kids, who are 24, 23 and 17 years old. 

    “We’ve never been apart from each other,” she said. “He is the one always making sure we’re OK.”

    Her youngest son, Julian, had to take final exams the day after his dad’s detention, but it helped that his teachers knew what he was going through, she said. 

    “My oldest son, he doesn’t know how to express his emotion, but I can see the sadness in his face, and he said he feels like the house isn’t home because his dad’s not here,” she said.

    The couple’s granddaughter, who is 3 years old, doesn’t understand why her grandfather isn’t home. “She grabs his picture and says, ‘I want to go with Papa,’” her name for her grandpa, Lopez said.

    Lopez, who is a U.S. citizen, said she applied for her husband to become a permanent legal resident after getting married in 2001, but the government initially denied the application, and the couple has been battling that decision in court for years. She said her husband was originally taken to a detention center in McFarland, but early Saturday morning, he called her from Tijuana and told her he was left there by immigration authorities without his Mexican passport or his California driver’s license. 

    “I lost it when he told me,” Lopez said. “This wasn’t the way it was supposed to go.”

    She immediately booked a flight to Mexico to bring her husband clothes and his birth certificate and help him complete paperwork to get a new Mexican passport. She plans to continue to fight the deportation in court.

    Students may be eligible for McKinney-Vento resources

    Mendoza, from the ACLU, said after a family member is detained, school staff should check if a student’s housing situation has changed, which could then make them eligible for services for homeless students, under the federal law known as the McKinney-Vento Homeless Assistance Act.

    If a student’s parent or guardian is detained, they may have to live with a new family member, for example, or the loss of income of one parent may require a student’s family to move to a new home. In that case, students have the right to stay in the same school even if they have moved farther away, and they may need help with transportation to get to school, Mendoza said.

    “Stability is really important,” said Mendoza. “But if they [school staff] don’t inquire about why an address has changed, they might miss that it’s a housing instability that would then trigger McKinney-Vento.”

    School personnel at a school district in Ontario, outside of Los Angeles, said they were recently approached by a grandmother who was caring for her grandchildren and needed food and clothing for them. Only after inquiring about their living situation did the district learn that the children’s parents had been detained by ICE. Their particular situation qualified them for homeless assistance resources.

    “I think there’s this hesitancy to talk about ‘what does this mean for our immigrant students?’ But I think it’s even more important now because we never know who students will feel comfortable sharing that information with,” said Karen Rice, a senior program manager at student-advocacy organization SchoolHouse Connection.

    So many of our members want to know, what do I do in the event that ICE does get past the office and into the classrooms?

    At Coachella Valley Unified School District, an uptick in fear of immigration enforcement is contributing to homelessness among families. Karina Vega, a district support counselor, said immigration-related changes in students’ lives vary widely. Some parents have had to temporarily leave the country as part of the residency process; others have a deported parent, leaving the remaining parent struggling to make ends meet on their own; others are constantly moving to stay off the radar of immigration officials. 

    The information from the state attorney general about how to help immigrant students and families is not always getting to teachers, said Yajaira Cuapio, a social worker with the San Francisco Unified School District. She said the teachers union, United Educators of San Francisco, is asking the district to include training on sanctuary policies in the teachers’ contract.

    “So many of our members want to know, what do I do in the event that ICE does get past the office and into the classrooms?” Cuapio said. “What are our rights? What do I do as an educator?”

    Twenty-five units of permanent, supportive housing have been made available to families of LAUSD students who have experienced chronic homelessness. 

    After more than seven years of collaboration, district officials and partners — including Many Mansions, a nonprofit that provides affordable housing to Los Angeles County and Ventura County residents — cut the ribbon for the new Sun King Apartments on Monday and vowed this would be the first of many structures to come. 

    “I am filled with hope and determination to continue bringing housing opportunities to more LAUSD families in need,” said school board member Kelly Gonez on Monday. “Because while we’re not in the housing business, we are in the business of doing everything we can to advocate for our students and families.” 

    High rates of poverty “should not be the reality in the richest country on Earth, in the richest state in the nation, in one of the richest counties of this state,” district Superintendent Alberto Carvalho added. 

    The Sun King Apartments — consisting of one, two and three bedroom apartments — are located in L.A.’s San Fernando Valley, where Gonez said there are several elementary schools where more than 20% of students are homeless. 

    The apartments’ residents are supported through a voucher, and their rent is based on a sliding scale. 

    In addition to the housing, residents will have access to a range of youth services — including after-school tutoring, summer camps, family events and school supplies, according to Rick Schroeder, president and CEO of Many Mansions. 

    Several of the district’s partners and collaborators on the project attended Monday’s event, including U.S. Rep. Tony Cárdenas, City Council member Imelda Padilla and the city’s chief housing and homelessness officer, Lourdes Castro Ramirez, along with business partners. 

    ‘Not stopping here’ 

    Annika, Angel and their daughter, Faith, live in one of the Sun King Apartments. 

    The parents, whose last names were not provided, met at a homeless shelter 16 months ago. 

    In late December, they — along with their daughter, Faith — moved into the Sun King Apartments. 

    “We all started a new chapter of our lives, and it has filled us with the highest hopes, blessings and glory,” Annika said Monday. “With the thanks to Many Mansions, we have been able to create a safe and stable chapter of life and a new home for our daughter, Faith.” 

    Noting that homelessness among school-aged children has increased, Carvalho said Monday that similar projects to house members of the Los Angeles community are critical.  He said the Sun King Apartments project is something “that we need to replicate and amplify very quickly.” The superintendent did not provide details or a timeline for when additional housing is expected.

    This initial effort took more than seven years, but Carvalho hopes future projects will take less time. 

    So far, the district has put out a request for information for seven potential properties — some of which may also serve as workforce housing for teachers and classified personnel, Carvalho said. 

    He declined to share how many people the district is ultimately looking to house and said Los Angeles Unified School District would pursue options that do not cost them financially.

    “How do you tackle (homelessness)? One unit at a time, 25 units in a building, many buildings, many mansions across our entire community,” Carvalho said. 

    “And why do we do this? … Families today live on the third floor. They see the mountains. They see the street. They’re close to the school where their baby girl attends. They feel maybe for the first time somebody paid attention, they’re important.”

    LAUSD families still struggling to access disability supports


    Special education has been inconsistent in California schools since the coronavirus pandemic.

    When the Covid-19 pandemic led to school shutdowns in 2020, and students began plugging into their classes online, Naomi Burn saw her 17-year-old son’s grades soar. 

    Her son seemed more engaged, completed his assignments and was in better spirits. The virtual classes seemed to serve him better. So, when face-to-face instruction returned, Burn decided to enroll him in one of the district’s virtual academies, where he would also be able to receive the counseling outlined in his individualized education program (IEP). 

    But in October 2023, Burn received an unexpected message from her son’s psychiatric social worker, who had previously provided him with the support he needed. 

    “He was removed from my caseload at the start of the year, and due to staffing issues, none of the virtual students are receiving their IEP services,” the email read. “I hope they are able to find a solution soon, so that he may begin to access this support.” 

    Several months later, Burn received an email from the district offering a solution: a chance to make up for lost services whenever the district has adequate staffing.  Karla V. Estrada, LAUSD’s deputy superintendent of instruction, told EdSource in January that any problems with unfulfilled IEPs at Burn’s son’s school had been fixed. 

    On Jan. 9, the next day after Estrada’s statement, Burn said nothing had changed. No one had reached out to her. Her son’s educational plan and needs were still not addressed, and the family was still waiting. 

    “I understand it’s a societal issue,” Burn said. “But, at the same time, today’s counseling minutes don’t help the child with yesterday’s emotional social barriers.” 

    Burn is one of many parents in the Los Angeles Unified School District who say they have struggled to get their children adequate disability accommodations and support this past academic year. They say the district has been largely unresponsive and are concerned about possible repercussions for their children. 

    Experts warn that not providing accommodations in a timely manner could worsen students’ disability symptoms, while adding additional hurdles, including social and emotional challenges. 

    Meanwhile, the number of district students with disabilities continues to grow, and teachers have sounded alarms that as their workloads skyrocket, more student needs could go unaddressed. 

    “There’s no time like the present. Right, time only moves in one direction,” said Rebecca Gotlieb, a human developmental psychologist and educational neuroscientist at the University of California Los Angeles. “And I want every student to have all the supports they need.” 

    An old tale 

    Students with disabilities have long struggled to get the support they need in Los Angeles Unified. In April 2022, a federal investigation found that the district had provided hardly any special assistance to students with disabilities during the height of the Covid-19 pandemic. 

    When students were attending school online, LAUSD allegedly decreased services provided to students with disabilities and failed to properly track them, according to the U.S. Department of Education investigation

    The agency also found the district informed its staff that LAUSD was not responsible for school closures and was therefore “not responsible for providing compensatory education to students with disabilities,” according to the report. 

    Meanwhile, the investigation determined that the district “failed to develop and implement a plan adequate to remedy the instances” when students with disabilities were not provided access to a fair public education during remote learning.  

    Soon after the investigations, the district  entered an agreement with the agency, promising to address the Department of Education’s concerns. 

    “Today’s resolution will ensure that the more than 66,000 Los Angeles Unified students with disabilities will receive the equal access to education to which federal civil rights law entitles them,” Assistant Secretary for Civil Rights Catherine E. Lhamon said in a 2022 media release. 

    “I am deeply grateful for the district’s commitment now to meet the needs of its students with disabilities.”

    Estrada told EdSource that the district conducts a report at the beginning of each academic year to find out how many students aren’t receiving the services they are entitled to and need. The process also helps the district come up with solutions, including providing services retroactively once they are available, she said. 

    “There are certain students that aren’t receiving special education services or as outlined in their IEPs,” Estrada said. “Sometimes, it’s not that they’re not receiving services, but not to what has been prescribed in the IEP.” 

    Less than a year after the investigation, parents and advocates sounded alarms that the district was not following through on their promises and that children were still going without necessary supports. 

    Lourdes Lopez is one of many LAUSD parents who have had to work tirelessly to get the necessary support for their children. She has two children with disabilities who rely on speech and occupational therapy. 

    “As a parent, we’re begging for the services the child needs,” Lopez said in Spanish. “But always, they say she doesn’t need it.” 

    Her son, Dylan, was eventually able to get an IEP at his elementary school. But Lopez said she’s worried that the services Dylan is receiving are not enough to tackle the challenges his disability poses. 

    “They give him 10 minutes, and he’s in a group. They ask questions to one; they ask questions to another. It’s really sad how very little they are giving him,” Lopez said in Spanish. “Then, they return him to the classroom.”

    A growing need 

    Lopez said that LAUSD students with disabilities are only able to graduate and stay confident into adulthood if “they’ve really had everything, all the services, all the support.”

    Going Deeper

    From language barriers to jargon-filled legal language in the IEP application process, families often struggle to get accommodations for their child in the first place, according to Paul Morgan, a social and health equity endowed professor at the University at Albany, SUNY.

    Sometimes, Morgan said, schools are not proactive about informing parents about services because they can be costly to offer. And there can be instances where students don’t get an IEP because the findings of a school evaluation don’t match the conclusions of outside providers. 

    To increase the odds of getting an IEP, Morgan stressed the importance of having objective measurements that can answer these questions: 

    • What kinds of challenges is your child having?
    • Have these challenges been going on for a period of time? 
    • How are they performing in relationship to their peers?

    “I know families that are coming from two parent, two income households [where]both parents are highly educated … and they have great difficulty getting the services,” Morgan said. “I’ve had parents say they have to fight like hell to receive those services from schools.”

    Adrian Tamayo, a special education teacher at Lorena Street Elementary School, is one of the LAUSD educators who work day in and day out to support students with special needs. 

    Tamayo arrives at school at 7:30 a.m. to begin a day packed with regular teaching duties like working with students and planning lessons — as well as unique responsibilities that come with a job in special education, including district and statewide assessments that track students’ progress. 

    As a special education teacher, he also helps students secure IEPs; he administers standardized tests and carries out observations that are central to that process. This past year alone, he has conducted about 34 IEP assessments, with each taking three to four hours. 

    “It’s amazing how much time out of our own time we put in outside of the typical school day for the average educator,” Tamayo said. 

    Tamayo says he and his colleagues feel overworked and understaffed partly because the number of special education hires across the district has fallen — alongside retention, which dropped from 90% to 77% among credentialed teachers in the past three years, according to a district committee presentation.  

    Meanwhile, special educators who remain are having to support an increasing population of students with disabilities — which has  grown from 13.4% to 15.9%, despite LAUSD’s overall enrollment dropping by about 20% in the past decade.

    Estrada, the district’s deputy superintendent of instruction, added that since the pandemic, providing speech and language services has been especially difficult due to staffing constraints — but that the district has been able to contract with an outside provider to help fill the void. 

    “You have so many service providers, and IEPs are happening constantly,” Estrada said. “So, (a) new IEP requires potentially new services, and so we’re constantly adapting and making changes to caseloads.” 

    Soaring caseloads

    This year, Tamayo’s caseload began at 19 students — and increased to 27 by the end of the year. A load higher than 28, he said, would violate California’s education code. 

    He said having the support of a paraprofessional in the classroom is invaluable — as it allows him to break his class into smaller groups based on grade level. But paraprofessionals aren’t always available. 

    “I have got to mentally prepare for any unforeseen (circumstances),” Tamayo said, adding that he is “always adjusting as we go.” 

    Tamayo said he is one of the lucky ones at Lorena Street Elementary; some of the programs have far surpassed their cap of 12 students, with a single professional working with up to 20 students. 

    He also said the number of psychiatric social workers at his school — supporting students with needs, like Burn’s son — has dropped. A year ago, there was one on campus every school day, he said. 

    This year, one was available to students three days a week, he said. Next year, he anticipates, they will be available only one day each week. 

    “That doesn’t mean that children that need that support also decrease,” he said. “You’re basically being asked to do the same job with one day of service.”

    Head Start offers path to success for children, families


    Malaya Peterkin and other preschoolers sat in bright blue chairs around a table on a recent afternoon, listening raptly to teacher Rachel Cepeda read a book about butterflies. Afterward, the children created butterfly-themed pieces of art.

    Malaya, age 5, attends the Head Start program at the Sharon Geese Early Learning Center in the Del Paso Heights neighborhood of Sacramento. Her mother, Timeisha Seymore, is confident her daughter will be prepared for kindergarten next school year. 

    “She hasn’t started kindergarten yet, and she can already read,” Seymore said. “My son is doing math already. He’s 4. … You know, they are learning, they are bringing these tools, and we are just ecstatic about it.”

    The children also learn science and, because of the diverse teacher workforce, languages that include Spanish and Mandarin, Seymore said.

    Seymore is among the many low-income parents who count on Head Start to prepare their children for kindergarten and to care for them while they work. The program, run locally by schools and nonprofit organizations, serves more than 750,000 children nationwide from birth to 5 years old.

    Now, Head Start parents, teachers and other supporters are worried that potential cuts during federal budget negotiations could either reduce the number of children who can attend the program or eliminate it.

    Program is more than child care

    Students in the Head Start program, operated by the Sacramento Employment and Training Agency (SETA), spend their days learning through play in brightly colored classrooms filled with books, blocks, toys and games. Children on tricycles zoom around the fenced playground, play in a giant sandbox or climb on a jungle gym under the watchful eyes of school staff during recess. 

    “It’s an amazing place,” Seymore said. “I love Head Start. My family would not be the same without Head Start.”

    The Sharon Neese Early Learning Center’s program serves 60 preschool students and 29 toddlers. It is one of more than 100 Head Start programs, serving a total of 4,400 students, that SETA operates at schools and other community sites in the Sacramento region.

    Head Start not only teaches children foundational math and reading skills, they receive healthy meals, referrals to dental and medical services, and behavioral support, said Melanee Cottrill, executive director of Head Start California.

    Head Start teachers, who work with students as young as 18 months, sometimes potty-train the children, teach them to wash their hands, how to eat healthy foods and how to take care of their bodies, said Annabel Stofer, who has been a teacher in the Sacramento program for 23 years.

    “Head Start is not just a great place for high-quality child care, we also support the family and the students to reach their potential, to connect them with resources, referrals, services that their children may need that they might not even know about,” Stofer said.

    Head Start serves children in deep poverty

    Head Start started in 1965 as part of President Lyndon B. Johnson’s War on Poverty. It serves children who are homeless, in foster care, on public assistance or whose family income is below the federal poverty level — currently $32,150 annually for a family of four. A limited number of students from families with slightly higher incomes are eligible if space allows. 

    “In a family living in deep poverty, parents are focused on, how am I going to pay rent, how am I going to buy food,” Cottrill said. “They don’t have much capability to focus on A, B, C’s and 1, 2, 3’s.” 

    Early Head Start programs enroll children before they are born, allowing their mothers access to prenatal services and home visits. After the child’s birth, Head Start staff screen the baby for developmental delays. Children as young as 18 months can take part in Early Head Start classroom-based programs for toddlers.

    Jackie Stephens had a home visit from a Head Start worker the morning she spoke to EdSource. The worker checked on her newborn son, Elijah, and offered lactation support. Stephens has been struggling to get Elijah to breastfeed. She tried to schedule an appointment with her medical provider but was told she would have to wait a week.

    “Head Start is about children,” a teary-eyed Stephens said as she discussed the possible funding cuts. “I get the funding part, and I understand, I truly do. But you have to look at the bigger picture — on the effect that it’s having on these children, that it’s helping these parents who are trying to work, who are trying to do better for their family. For something to be ripped apart because of money, it just doesn’t seem right to me. … I pray that it doesn’t happen.”

    Parents are involved

    Family engagement is important at Head Start. Parents are involved at every level of the organization, including as members of the National Head Start board. 

    Teachers meet with parents throughout the year to ensure families aren’t in need of services and to develop educational plans for students. They also help families with their child’s transition to kindergarten — helping them navigate immunization and medical requirements and registration, Stofer said.

    “We’re a family,” she said. “… I consider these children my grandchildren, too. I have three of my own. But these children are equally as important to me emotionally.”

    Stofer finds it difficult to believe the program, in existence for 60 years, could be gone in one presidential administration.

    “I can’t even imagine a world without Head Start,” she said.

    What could replace Head Start?

    If Head Start funding is cut, preschool-age students could be eligible for the California State Preschool Program, which enrolls children beginning at age 3, and transitional kindergarten (TK), which enrolls them at age 4. 

    But Head Start supporters say TK doesn’t offer all the services that low-income families need and that its shorter day isn’t long enough for working families. Head Start programs are generally available at least six hours a day.

    About 75% of all Head Start programs also operate California State Preschool programs at their site with similar services and hours. Early childhood education programs often weave funding from both Head Start and the California State Preschool programs to provide or expand services to all their students.

    But the state isn’t expected to increase funding for additional seats in the California State Preschool Program in the near future, Cottrill said. That means that while early childhood education programs might remain open if Head Start funds are cut, they may have to close centers or eliminate seats, she said.

    California program meets local needs

    California’s Head Start program is unique in that it is designed to meet local needs, Cottrill said. There are Head Start programs in homeless shelters, at schools, in community centers and in private homes.

    “One of my favorite examples is that we have a preschool program that is kitty-corner from a library, so they take the parents to the library, and they help them get their library card and access everything that the library has to offer,” Cottrill said. “So, really, it’s about uplifting the entire family.”

    In rural areas of the state, Head Start staff make home visits, offering curriculum to parents and helping them understand their child’s development. 

    Cottrill is hopeful that Head Start will survive upcoming budget negotiations in Washington.

    “What a tragedy it would be to end the program after 60 years of supporting the American Dream,” Cottrill said. “That’s really what we’re talking about, right? This program builds that. It sets people up on a path for success when they did not have it before.”

    New law moves toward better translation of special ed documents, but families want more

    California schools will soon have a template for special education programs translated into 10 languages in addition to English.

    Advocates and parents of children with disabilities who speak languages other than English say it is a tiny step forward, but there is still work to be done to fix long waits and faulty translations experienced by many families statewide.

    “Ultimately, if parents can’t receive translated documents, they can’t meaningfully engage in their child’s education,” said Joanna French, senior director of research and policy strategies at Innovate Public Schools, an organization that works with parents to advocate for high-quality education. “They can’t provide informed consent. They can’t ask questions or push back on the services that are being proposed.”

    A bill introduced last year by state Sen. Anthony Portantino, D-Burbank, would have required school districts, charter schools and county offices of education to translate individualized education program (IEP) documents within 30 days. But the bill stalled in the Senate Appropriations Committee, where lawmakers decide whether the state has enough money to pay for legislation. This spring, the bill was revived, and Portantino revised it to require the California Department of Education (CDE) to create guidelines suggesting, rather than mandating, timelines for translation and how to identify quality translators and interpreters. But that version, too, was eventually scrapped. 

    The version of the bill that finally did pass the Legislature and was signed by the governor requires a template for IEPs to be translated into the 10 languages most commonly spoken in California other than English. The translated template must be made available online by Jan. 1, 2027. The template, which can be found in this document, includes categories of services, but also has blank space for language adapted to each student.

    “Obviously, whenever you get a partial victory, you take it and you celebrate,” said Portantino. “This is an incremental improvement. Having the template is a good thing. But obviously, these are individualized plans, so my hope is that someone takes up the mantle to get individual plans translated in a more timely manner.”

    Aurora Flores said she has had to wait sometimes six or seven months for special education documents to be translated into Spanish. Her 10-year-old son has Down syndrome and autism and attends school in the Long Beach Unified School District.

    “It’s really sad for us Spanish-speaking parents because the points that you want to clarify, you can’t understand. They just summarize really fast, with an interpreter, but sometimes it’s not a certified person,” said Flores in Spanish.

    Individualized education programs are required for students with disabilities who qualify for special education, and are updated each year or when needs change. Before schools can implement these programs, parents must agree.

    The person most affected by long waits for translations is her son, Flores said, because it takes longer for her to sign off on new services that he needs.

    “When you least expect it, you realize the next IEP meeting is coming up, and you have just received the documents from the last one,” Flores said.

    A spokesperson for Long Beach Unified, Elvia Cano, wrote in an email that the district “is dedicated to ensuring that all families, regardless of their primary language, have timely access to critical educational information, including Individualized Education Programs (IEPs).”

    However, she said getting high-quality translations of special education documents can be challenging.

    “Translating IEPs requires specialized linguistic and technical expertise. Translators must be fluent in the target language and possess a strong understanding of educational terminology. Finding professionals with these qualifications can be challenging, especially for less commonly spoken languages. Additionally, the complexity of IEPs and the volume of translation requests may extend the timeframe for completion,” Cano wrote.

    Portantino said that some felt the previous version of the bill requiring the California Department of Education to create guidelines for translation “was too onerous, too much pressure.” 

    “I think the education community didn’t want to be forced to do things. I think there were districts who felt they don’t have the personnel, and I think CDE felt the overall structure was not in place,” Portantino said. 

    Holly Minear, executive director of student services at the Ventura County Office of Education, said she thinks most school districts and county offices understand the importance of giving families a written translation of IEP documents in a timely manner, but it is sometimes a challenge, especially when the translation is for a language that is not common.

    “I think a lot of districts use internal translators, and if you have someone out sick or on leave, or if districts work with contract agencies, sometimes the timeline is more than 30 days,” Minear said. 

    Minear said the Ventura County Office of Education has two Spanish-English translators on staff, but they use outside agencies for other languages like Farsi and Mixteco, an indigenous language from southern Mexico. She said she thinks the template will help districts and translators do a better job.

    “Although our IEPs differ … I think we use a lot of the same terms, a lot of the same language,” she said. “I’m really looking forward to having it on the template, because if there’s ever a word or phrase you need, it’s there for you, and it’s free.”

    Sara Gomez, who has a 4-year-old with autism who attends preschool in Santa Clara County, said she thinks the law is a good step forward.

    “I think the law is positive, in that it gives a sense of alarm that translations need to be done urgently,” Gomez said. “But we still don’t have a required timeline.”

    Gomez said she has had to wait three or four months for her son’s individualized education program to be translated into Spanish. Gomez, who is from Venezuela, speaks English, but her husband speaks only Spanish.

    She said she has heard of other parents waiting up to a year for translations, leaving them unable to make informed decisions about their children’s education.

    “Even four months for a young child make a big difference,” Gomez said in Spanish. “When they are the youngest is when they need the most help.” 

    Advocates and families said they will keep pushing the state for guidelines about how to access qualified translators and a time limit for translations. 

    “We understand that districts experience challenges in finding qualified translators, especially for less common languages, and turning around documents quickly,” said French, from Innovate Public Schools.

    However, she said, different districts have very different timelines for translations.

    “We don’t believe it should be that inconsistent, if a parent lives in one district versus another,” French said. “There should be equity across the state about what a parent should expect in terms of translated documents.”

    Allegra Cira Fischer, senior policy attorney for the nonprofit organization Disability Rights California, agreed. She said she was dismayed to see that the 30-day timeframe was removed from the bill.

    “Parents tell us that sometimes their student will have a better teacher or a better case manager and they’ll get things in a more timely manner. But parents shouldn’t have to rely on an especially committed teacher or case manager,” Fischer said. “This is a situation that is really untenable and ultimately is harmful to children with disabilities.”

    In the first months of the first Trump administration in 2017, a father in Los Angeles was detained by Immigration and Customs Enforcement (ICE) after dropping his 12-year-old daughter off at school.

    The ripple effect was immediate.

    “Right away there was a drop in attendance in L.A. schools because parents were thinking, ‘Oh, if I drop off my kids, ICE is going to pick me up,’” said Ana Mendoza, senior staff attorney at ACLU of Southern California and director of the organization’s Education Equity Project. “The need for safety and sanctuary policies became really salient because students weren’t going to schools or families were tentative about their participation in schools.”

    In the wake of this year’s presidential election, there is again widespread uncertainty among immigrant families in California about what is to come, given President-elect Donald Trump’s promises of mass deportation.

    State Attorney General Rob Bonta recently released updated guidelines and model policies about what K-12 schools, colleges and universities can and cannot do under state and federal law, regarding keeping immigrant students and families’ data private, when to allow an immigration enforcement officer on campus, how to respond to the detention or deportation of a student’s family member, and how to respond to bullying or harassment of a student based on immigration status.

    The original guidelines and policies were released in 2018 by then-Attorney General Xavier Becerra, after California passed Assembly Bill 699, requiring schools to pass policies that limited collaboration with immigration enforcement. Bonta is now asking schools to update their policies.

    “School districts should be examining what their board policies are and to make sure they’re updated and take any measures to make sure that families feel safe,” Mendoza said.

    An estimated 1 in 10, or 1 million, children in California have at least one undocumented parent. And about 133,000 children in California public schools are undocumented themselves, according to the Migration Policy Institute.

    In California’s colleges and universities, an estimated 86,800 students are undocumented, and about 6,800 employees in TK-12 schools, colleges and universities have temporary work permits and protection from deportation under Deferred Action for Childhood Arrivals, or DACA, according to the Higher Ed Immigration Portal.

    “Undocumented students and faculty and staff are afraid for their safety, and this will impact their retention and enrollment in higher education if they’re not feeling safe or they’re feeling targeted,” said Luz Bertadillo, director of campus engagement for the Presidents’ Alliance for Higher Education and Immigration, a national organization of college and university leaders. “For campuses to have a strong stance on what they’re doing to support undocumented students is important, or at least letting their students know they’re thinking about them and they’re taking action. Even though they cannot guarantee their safety, at least they’re taking those initiatives to safeguard.”

    What rights do immigrant students and family members have at school and college, regardless of their immigration status?

    The right to attend public school 

    All children present in the United States, regardless of immigration status, have a right to attend public school. In 1982, the Supreme Court ruled in the case Plyler v. Doe that states cannot deny students a free, public education based on their immigration status or their parents or guardians’ immigration status. Some states — including California in 1994 with Proposition 187 — and school districts have since attempted to pass laws that would either deny enrollment to students who did not have valid immigration status or report their status to authorities, but all these laws have been struck down by courts.

    California schools are not allowed to request or collect information about Social Security numbers, immigration status or U.S. citizenship when enrolling students. Students and parents do not have to answer questions from schools about their immigration status, citizenship or whether they have a Social Security number.

    “This often comes up in requests for student documents,” Mendoza said. “I had an intake once where a parent gave a passport during enrollment, and the front office person was asking the parent for a visa. No. The school has no right to ask for documents about your citizenship or immigration status.”

    Schools can ask for some information like a student’s place of birth, when they first came to the U.S. or attended school in the U.S., in order to determine whether a student is eligible for special federal or state programs for recently arrived immigrant students or English learners. However, parents are not required to give schools this information, and schools cannot use this information to prevent children from enrolling in school. The Office of the Attorney General suggests that schools should collect this information separately from enrolling students.

    Privacy of school records

    The federal Family Educational Rights and Privacy Act, or FERPA, restricts schools from sharing students’ personal information in most cases with other agencies or organizations, including federal immigration authorities. The law requires that schools get a parent or guardian’s consent before releasing any student information to another agency or organization, or if the student is 18 or older, schools must get consent from the student.

    However, in some cases, schools may be required to provide information without consent in response to a court order or judicial subpoena.

    Colleges are also restricted from sharing information except in certain cases. Bertadillo said her organization recommends that college leaders have conversations with all the different departments that might manage information about students’ or families’ immigration status, such as information technology, admissions, registrar, and financial aid, to review their practices for storing or sharing the data.

    “We hear some campuses have citizenship status on their transcripts and those transcripts get sent to graduate schools, to jobs, and that’s essentially outing students,” Bertadillo said.

    She said it’s important for colleges and schools to pass or revisit procedures about what to do if immigration officials ask for data or attempt to enter a campus.

    “A lot of institutions created them back in Trump 1.0. We’re recommending they reaffirm or revisit them, so that the campus knows that this is in place,” Bertadillo said.

    Safe haven at school

    The Department of Homeland Security has designated schools and colleges as protected areas where immigration enforcement should be avoided as much as possible. President-elect Trump has said he may rescind this policy.

    In the event that ICE officers do enter schools or ask to question students, the attorney general’s guidelines say school staff should ask officers for a judicial warrant. Without a judicial warrant, school staff are not required to give an ICE officer permission to enter the school or conduct a search, or to provide information or records about a student or family, the guidelines say.

    A bill introduced by state Sen. Lena Gonzalez, D-Long Beach, and State Superintendent of Public Instruction Tony Thurmond would establish a “safe zone” of 1 mile around schools and prohibit schools from allowing ICE to enter a campus or share information without a judicial warrant.

    Under California law, schools must notify parents or guardians if they release a student to a law-enforcement officer, except in cases of suspected child abuse or neglect.

    California law does not require schools to notify parents or guardians before law enforcement officers question a child at school, but it does not prohibit schools from notifying them either. California’s attorney general suggests that school districts and charter schools should create policies that require notification of parents or guardians before a law enforcement officer questions or removes a student, unless that officer has a judicial warrant or court order.

    In addition, the attorney general says if a police officer or immigration agent tries to enter a school or talk to a student for purposes of immigration enforcement, the superintendent or principal should e-mail the Bureau of Children’s Justice in the California Department of Justice.

    “Schools should retrain their staff on their visitor management policies, to make sure everyone who comes onto campus, including law enforcement, is questioned about what their purpose is, and that school staff is trained on what to do if law enforcement asks to see information about students or staff,” said Mendoza.

    Support from school if a family member is detained or deported

    If a student reports that their parents or guardians were detained or deported, California law requires that the school must follow parents’ instructions about whom to contact in an emergency. The attorney general’s guidance says “schools should not contact Child Protective Services unless the school is unsuccessful in arranging for the care of the child through the emergency contact information.”

    The guidance also suggests that schools should help students and family members contact legal assistance, their consulate, and help them locate their detained family members through ICE’s detainee locator system.

    Mendoza said it is important to note that if a student’s parents are detained or deported, and as a result they have to go live with another family member, at that point, they are eligible for support for homeless students under the federal McKinney-Vento Act.

    Protection from discrimination and harassment

    Federal law prohibits discrimination and harassment based on race, national origin, color, sex, age, disability and religion. California’s law AB 699 also made immigration status a protected characteristic, meaning that schools are required to have policies that prohibit discrimination, harassment and bullying based on immigration status.

    Mendoza said it’s important for families and students who experience bullying or harassment to know they can submit complaints through their schools or to different agencies in California. “There are advocates out there willing to support them if their schools do not act in accordance with best practices or with the law,” Mendoza said.

    Free lunch, subsidized child care and special education

    In California, all students have a right to a free school lunch, since the 2022-23 school year. In addition, some students whose families are considered low-income qualify for subsidized child care, either all day for infants and preschoolers, or after school for school-age children. Students with disabilities have a right to special education to meet their needs, under federal law.

    Immigrant families are often afraid to apply for public services because they are worried this will count against them when applying for permanent residency. This is largely due to the “public charge” test, which immigration officers use to determine whether green-card applicants are likely to depend on public benefits. 

    Currently, immigration officers can only consider whether applicants have used cash assistance for income, like SSI or CalWORKs, or long-term institutionalized care paid for by public insurance, such as Medi-Cal. They do not consider school lunch, child care or food stamps. And officers are not allowed to look at whether applicants’ family members, like U.S. citizen children, use public benefits. During the first Trump administration, the president changed this policy to include family members and some other benefits. It is unclear whether he may attempt to change this again in the future. However, even under the changes during his first term, school lunch and child care were not included.

    In-state tuition and scholarships for college

    Under the California Dream Act, undocumented students qualify for in-state tuition and state financial aid at California colleges and universities if they attended high school for three or more years or attained credits at community college or adult school and graduated from high school or attained an associate degree or finished minimum transfer requirements at a California community college. The number of students applying for the California Dream Act has plummeted in recent years.

    As Gov. Gavin Newsom stood near a burned-down school, Pacific Palisades mom Rachel Darvish pleaded with Newsom: “That was my daughter’s school, what are you going to do?” Newsom offered no real answer for the distraught parent at the time. 

    Well, here’s the answer he should have given: All families affected by the Los Angeles fires should be eligible for emergency education savings accounts that parents can use to pay for education alternatives for their children.

    The Los Angeles fires have not only destroyed people’s homes and businesses, they have also razed neighborhood schools. Initial reports indicate at least a dozen schools in the Los Angeles area have burned, affecting more than 5,700 students. 

    In the Altadena area, which was devastated by the Eaton fire, nearly 2,000 students are school-less.

    “I’m just really sad,” one 7-year-old Altadena girl told a CBS-TV reporter, “because I love that school.”

    Describing the impact of losing her children’s neighborhood school, an Altadena mom said: “School is a big part of it because it’s the foundation of a family’s daily life. Now we don’t have that anymore.”

    The sad reality for affected families is that rebuilding schools, like rebuilding homes, will take a lot of time and money, and only $1 million of Newsom’s $2.5 billion wildfire relief bill was designated for rebuilding schools.

    Even in normal times, it takes two years or more to build a school, and school construction costs range from $70 million to $100 million per school. 

    What are families to do in the meantime?

    Many affected families have been dispersed to various parts of Southern California and beyond. Since their homes will not be rebuilt soon, government leaders can address the individual needs of children in this diaspora by giving every child affected by the fires a publicly funded education savings account.

    According to the school-choice organization EdChoice, education savings accounts “establish for parents publicly funded government-authorized savings accounts with restricted, but multiple uses for educational purposes,” to be used in-state.

    Parents can use these funds to cover “school tuition, tutoring, online education programs, therapies for students with special needs, textbooks or other instructional materials, and sometimes save for college,” whatever policymakers determine. Some programs cover home school costs. 

    California leaders can model on Arizona, where education savings accounts are funded at 90% of the state’s per-pupil funding, with special needs students receiving higher amounts. 

    In Newsom’s proposed 2025-26 budget, $83 billion from the state’s general fund would go to K-12 education. Using Arizona as a guide, $12,800 could be made available for these accounts for each affected child.

    With thousands of affected students, the total cost for an emergency education savings account program would be around $73 million — a drop in the bucket compared with the billions of dollars in aid being discussed for other aspects of the affected areas.

    Education savings accounts are popular with parents. In Arizona, a large majority of parents support such accounts.

    For example, after talking with Arizona State Board of Education member Jenny Clark about the state’s education savings account program, one family said, “We continue to utilize the … program to tailor our son’s education to meet both his great strengths and real challenges.”

    Today, 18 states from Wyoming to West Virginia have similar programs.  

    Public schools could be held financially harmless during the existence of these accounts. As EdChoice noted, in states with school choice programs, “many have funding protection policies.” In California’s case, districts could continue to receive their current average daily attendance funding.

    Education savings accounts could be funded through the billions of dollars in aid the state will surely receive from the federal government. President Donald Trump would likely look favorably on this program since he proposed a similar program at the federal level in his first administration.

    The education savings account program should be reevaluated after a few years to ensure it’s working as designed and improved as needed.

    While the catastrophe of the Los Angeles fires has created great uncertainty, one thing is certain: Parents affected by the fires will need the flexibility to pivot and choose educational alternatives that best suit the individual needs of their children.

    Parents cannot wait for bureaucratic processes to rebuild the schools that had been. These families need tools right now to pay for and provide for educational services to meet their immediate needs. 

    “We are so thankful for the educational freedom,” said another Arizona family that used their account funds for a home school hybrid program. 

    With National School Choice Week upon us, it is a perfect time to give fire-affected Los Angeles parents the freedom and flexibility they so desperately need.
