    Most California high school seniors shut out of even applying to the state’s universities


    Christian Robinson always planned to go to college, but when she graduated from Adelanto High School in California’s High Desert, she felt aimless. Without a plan or preparation for higher education, she decided to go to work instead.

    She regrets that now.

    “I wish I would have gone straight into college because I would have had everything done, finished and over with,” said Robinson, who at 20 is now enrolling at Victor Valley College.

    Currently, Robinson juggles two jobs, working for a security company and serving fast food. She wishes she had received more guidance about attending college from her school. 

    Robinson’s story was typical for Black students at Adelanto High School, where over 8 out of 10 Black students graduated in 2020 without the college prep courses — known as A-G — required for admission to California’s public universities.

    The path has been different for her younger brother MarQuan Thornton, currently a high school senior at Adelanto. Months away from graduation, Thornton is one of a small group of students deciding not whether he will go to college, but which one.

    Thornton has worked hard but recognizes that the key difference between his trajectory and his sister’s is the support he’s getting from school that did not exist during his sister’s time there.

    Three years after his sister graduated, his high school began the Heritage Program, which is aimed at ensuring that Black students, like him, are on track to complete their A-G requirements.

    Thornton knows he’s on track to meet the requirements that will make him eligible to attend a state university. 

    “If she (Christian Robinson) had this type of chance when she was in high school, she probably would have been where I am at,” Thornton said. “I can see the difference.”

    While the vast majority of students in California — 86% of seniors in 2023 — graduate from high school, most — 56% in 2023 — do not complete their A-G requirements, according to an EdSource analysis of data from the California Department of Education. EdSource’s analysis found that Black and Latino students are the hardest hit.

    In 2023, 68% of Black students and 64% of Latino students did not meet A-G requirements, compared with 26% of Asian students and 48% of white students, according to EdSource’s analysis. 

    The highest non-completion group is foster students at 88%, followed by disabled students at 85% and English learners at 82%.

    “These kinds of numbers should be treated as a five-alarm fire,” said Melissa Valenzuela-Stookey, director of P-16 research for Ed Trust-West, a nonprofit that advocates for justice in education. 

    Valenzuela-Stookey said high school graduates are being shut out of affordable four-year public college options, because they are not getting the support they need to complete the A-G coursework. 

    “Our education systems urgently need to invest more in our students of color,” Valenzuela-Stookey said.

    As Robinson neared graduation in the early days of the pandemic, she said everyone, even teachers, seemed to lose track of how to prepare students for college and life after high school. 

    But long before the pandemic, the district was struggling to prepare Black students to meet their A-G requirements and be ready for higher education, according to Ratmony Yee, assistant superintendent of educational services for Victor Valley Union High.

    Robinson’s mother, Crystal Francisco, says that she is proud of how hard her daughter works to earn her own money. But she concurs that if Heritage had been around, Robinson might have gone straight to college.

    “She probably would have gone a different way,” said Francisco.

    Of 1,766 high schools in California, about half graduated more than 56% of students lacking the required college preparatory courses. 

    Fewer than 2 out of 10 students met A-G rates in 2023 in many northern counties, such as Lake, Del Norte, Plumas, Lassen, Nevada, Tehama, Trinity. Just 3 out of 10 students in Kern, Merced, Tulare and Kings counties met the requirements. That compares to the Bay Area in San Mateo, Santa Clara, Alameda and Marin counties where more than 5 out of 10 students met A-G requirements. 

    Improving low A-G completion rates has been a longtime goal of both educators and state policymakers, but it’s a problem that resists easy answers or quick fixes, said Sherrie Reed, executive director of the California Education Lab at UC Davis and a researcher with Policy Analysis for California Education (PACE), an independent research nonprofit affiliated with several California universities.

    The idea of simply aligning the state’s minimum high school requirements with A-G requirements hasn’t gained steam because of the concern that it would result in fewer students graduating, said Mayra Lara, the director of Southern California partnerships and engagement with Ed Trust-West.

    What are A-G requirements?

    The details of A-G requirements can be arcane, especially for students and parents who are not familiar with the college admissions process.
    The state requires students to complete a minimum of 13 courses to receive a high school diploma.

    But to attend a UC or CSU requires that a student takes 15 courses in seven areas: history, English, math, science, foreign language, arts and an elective. Each category has its own letter, A-G, which is where the requirements get their name.

    These courses overlap with high school requirements, but they are also more rigorous. For instance, three years of English are required to graduate from high school, while A-G eligibility requires four years. Only one of those years can include English as a Second Language or English Language Development — courses that English learners are often enrolled in.

    Low grades are a common way students fall off the A-G track. A “D” is considered a passing grade for a high school diploma, but A-G classes require at least a “C” to count as eligible.

    The state, instead, has offered carrots for districts working on improving poor A-G rates, especially those that have a large marginalized student population, such as those who are low-income, English learners, homeless or have a disability. In 2021-22, the state set aside over $547 million for the A-G Completion Improvement Grant Program. The state has also pushed dual enrollment and career technical education to the high school curriculum, both of which can help students meet their A-G requirements.

    Progress has been slow. The number of students who have met A-G requirements statewide has ticked up just shy of four points over the last six years. 

    Understanding why any given student may or may not meet A-G requirements requires examining what is happening in a particular region or district, as well as disparities within schools.

    “The answer is that it is all of that,” said Reed. “No one factor accounts for it.”

    Some students said that graduating without meeting A-G requirements sent them the message that they were not college material.

    Brock Wooster-Mills, 20, said he felt “doomed to fail” as a student with a disability attending Liberty High School in Bakersfield, where 49% of students do not meet A-G requirements.

    Partial hearing loss had affected Wooster-Mills’ ability to speak and follow lessons in elementary school. But even when his hearing improved, his counselors in the Kern High School District wouldn’t allow him to transfer into required A-G courses such as French and geometry. 

    He remembers one special education teacher telling his class that they likely wouldn’t even attend a community college, but Wooster-Mills said he always knew he was capable of more. He enrolled in Bakersfield College in 2021, the fall after he graduated. 

    He’s now in his sixth semester, but his lack of academic confidence and inadequate preparation continue to dog him. In high school, he had never been taught how to write an essay. He had never studied a foreign language, which made Spanish daunting. He failed the first time he took it.

    “I feel like I’m still behind,” he said. “I wasn’t taught what I was supposed to be taught.”

    College increasingly important for economy

    Researchers say that preparing students for college is increasingly important for the American economy. By 2031, 72% of jobs will require a college degree or post-secondary education such as an associate degree, according to the Georgetown University Center on Education and the Workforce

    Most high schools in the state — 91.4% of traditional district schools, according to PACE — do offer a full slate of A-G coursework that put them on track for college. But the degree of access students get to those courses or support, once they have enrolled, varies greatly, resulting in wide disparities between groups of students.

    PACE released a series of briefs and reports on the A-G completion rates in summer 2023, noting that access to rigorous coursework — whether dual enrollment, Advanced Placement or other college preparatory courses — can profoundly change the trajectory of a student’s life. These courses not only set students up for admission to college, but make it more likely that a student will pursue college in the first place.

    Researchers found that some high schools do not offer the full range of A-G courses. In 2018-19, 2.5% of schools offered no A-G courses, and another 6% only offered some A-G courses. The list also includes small and rural schools that struggle to hire teachers who are qualified to teach A-G required classes in fields such as math, science or foreign language. 

    But 84% of schools that do not offer a full range of A-G courses are charter schools focused primarily on credit recovery for students at risk of not graduating from high school. Charter schools tend to be outliers in both directions; schools with the highest and lowest A-G rates — where fewer than 40% or greater than 80% of students meet A-G requirement — tend to be charters.

    Changes in high school can help

    Adelanto High is a part of Victor Valley Union High School District, which serves communities in the High Desert, including Victorville. Cheap, abundant land attracts residents priced out of the Southern California housing market, but there is little economic opportunity. Unemployment is high, and so is the poverty rate.

    “The kids get stuck here, because there’s a cycle of poverty,” said Aleka Jackson-Jarrell, the coordinator of the Heritage program at Adelanto High.

    Educators in Victor Valley Union High say that beyond ensuring that students have all of their options open to them upon graduation, it is not their role to choose a path for students. Military or trade school are options celebrated at the school, but educators tell students that a bachelor’s degree will be key for most students who aim to earn better wages and escape the cycle of poverty.

    “Money talks,” said Yee, assistant superintendent of instructional services for Victor Valley Union High.

    District leaders say ensuring that students meet their A-G requirements opens up two key options for students: being eligible to apply for a CSU or UC school, and also having the preparation to succeed at a community college.

    Like much of inland California, the rate of students completing their A-G is low in Victor Valley Union High. In 2016-17, 13% of students in the district completed their A-G coursework, but it has been improving: that number rose to 29% last year.

    Victor Valley Union High has been making districtwide changes that administrators say are key to putting more students on track for A-G completion. 

    Scheduling is important, Yee said. Creating a master schedule that prioritizes disabled students or English learners ensures these students aren’t missing A-G coursework because of a scheduling conflict. Some schools also build tutoring into daily schedules for struggling students.

    The district studied students’ transcripts to figure out how to improve their chances of meeting A-G requirements. For instance, they found that students who took foreign language classes as freshmen or sophomores were more likely to fulfill this requirement, because they had time to retake classes to make up for any poor grades. Students are now required to begin their foreign language courses by sophomore year. 

    Victor Valley Union High also rolled out two programs aimed specifically at groups of students that were struggling the most: Black students and long-term English learners. 

    Homing in on groups who need the most help

    The Heritage program, aimed at Black students like MarQuan Thornton, was piloted in 2022-23 at Adelanto High. Beginning sophomore year, every Black student in this High Desert school is automatically enrolled in this program that ensures students are prepared for graduation as well as college and a career.

    Thornton said the program has helped him, even ensuring that he made up classes he struggled with his sophomore year. He now boasts a 3.7 GPA.

    A-G completion rates for Black students at his high school improved. In 2021-22, 6% of Black students met their A-G. The following year, when Heritage began, that number jumped to 26%.

    Because of its early success, the program is not only being rolled out at other campuses in the district, but is being used as a model for Legacy, a program aimed at long-term English learners.

    Students in both Heritage and Legacy are sorted in four groups. Level 1 students are on track to graduate from high school with A-G requirements, while Level 4 students may be in danger of not graduating from high school at all. The coordinators hold monthly sessions with each group on topics ranging from how to fill out the FAFSA form or make up failed classes to basic life skills that students approaching adulthood need. Students also visit college campuses. 

    Parents are invited for workshops to school so that they can understand the importance of A-G classes and learn how to support — and perhaps badger — their children into staying on track. 

    Heritage coordinator Jackson-Jarrell said that having a background similar to her students’ helps her connect with them. She dropped out of high school when she was younger. She tells students that earning degrees — starting with an associate degree and ultimately obtaining a doctorate — helped her go from making $4.25 an hour to making six figures.

    Her counterpart at Silverado High, Jose Velasco, teaches Spanish and runs the Legacy program. Like many of his students, Velasco is a child of immigrants whose first language was Spanish. He checks in to make sure students have access to bilingual aides so that they can understand the content in their college preparatory classes, such as geometry or history.

    When Heritage first began, Jackson-Jarrell experienced pushback from non-Black teachers, parents and students questioning the need for a program focused solely on one group of students and pointing to other programs such as AVID, that focused on college and career readiness.

    “We were hit with questions like, ‘Why is this program just for Black students? It’s not fair,’” she said. 

    Jackson-Jarrell would tell them that the data was showing that overwhelmingly, Black students need the most support meeting A-G requirements and that they have unique needs and challenges that Heritage addresses. When students visit college campuses, they try to imagine themselves fitting in. Not seeing Black students on campus can reinforce the idea that they don’t belong on a college campus.

    “They’re looking for themselves,” said Jackson-Jarrell. “They feel like they don’t belong.”

    So, Heritage will often ensure that when they visit campuses, they can meet directly with students from the Black student resource centers. This upcoming spring, Heritage students are invited on a tour through the American South, visiting historically Black colleges and universities. Legacy makes a point of visiting with Latino student groups on campus for similar purposes.

    Jackson-Jarrell said that programs like Heritage and Legacy are important for the economic development of the community and hopes to see more programs like them in other districts in the High Desert.

    Superintendent Carl Coles concurs. Increasing the rigor of students’ coursework and preparing them for higher education doesn’t just set students up for success, it improves the prospects of their families and the larger community. The district’s renewed focus on A-G requirements, he said, goes right to the core of why education is so important.

    Coles said, “It really is so that every kid can live a life of purpose.”

    John Thompson: “Proficiency” Is NOT Grade Level, Not Even in Oklahoma


    Oklahoma’s State Superintendent, Ryan Walters, changed last years’ testing cut scores, redefining the term “proficient” in the state’s accountability data. Fortunately, there has been a bipartisan backlash against Walters’ lack of transparency when making the change, which looked like an effort to trick Oklahomans into believing that he had improved student outcomes.

    But, this month, the Oklahoma Commission for Educational Quality and Accountability brought back a misleading, inappropriate, and destructive definition of the term proficiency for accountability purposes.

    In doing so, the Commission revitalized the use of one of the most effective weapons for privatizing public education. They perpetuated the lie that “proficiency” is “grade level,” thus making it sound like public schools are irrevocably broken. 

    We need to remember the history of this propaganda which took off during the Reagan Administration, which misused data in its “A Nation at Risk” to push high-stakes testing.

    The National Assessment of Educational Progress (NAEP) scores are the best estimate of students’ outcomes, but they should be used for diagnostic, not accountability purposes.   But, as the Tulsa World reported, in 2011, Jeb Bush’s Foundation for Excellence in Education (FEE) high-jacked NAEP’s terminology when writing and editing then State Superintendent Janice Barresi’s new accountability-driven A-F school report card. The World presented evidence that the FEE was engaged in a “pay-to-play” scheme to reap profits while influencing policy.

    As The Washington Post reported in 2013, FEE was at the nexus of rightwing political influence in K-12 education and corporate interests seeking to profit from the nation’s schools. It claimed that raising “expectations” for students would advance their learning. In fact, NAEP scores provide evidence that starting in 2012 , when corporate reforms were in place, the opposite happened, as NAEP scores declined, reversing decades of incremental growth.

    It did, however, advance the privatization of public education.

    At the 2024 Oklahoma conferenceBush’s new think tank, ExcelinEd used misleading and misconstrued data from the National Assessment of Educational Progress (NAEP), to conflate NAEP “proficiency” with “grade level.”

    In fact, as Oklahoma Watch’s Jennifer Palmer explained, Oklahoma’s 8th grade reading proficiency grade requires that “students demonstrate mastery over even the most challenging grade-level content and are ready for the next grade, course or level of education.” That definition of mastery of grade level skills included critical thinking, interpretation, evaluation, analysis, and synthesis when reading across multiple texts, and writing.

    But, Palmer noted, “8th graders who didn’t score proficient, but are in the ‘basic’ category, can still do all this.”

    Moreover, as Jan Resseger further explained, the nation’s NAEP proficiency grade “represents A level work, at worst an A-.” She asks, “Would you be upset to learn that “only” 40% of 8th graders are at an A level in math and “only” 1/3rd scored an A in reading?”

    Resseger also cited the huge body of research explaining why School Report Cards aren’t a reliable tool for measuring school effectiveness.

    We need a better understanding how and why the word “proficiency” has been weaponized against schools. To do so, we must master the huge body of research which explains why standardized tests aren’t fair, reliable, or valid measures of how well schools are performing.

    In 2013, after surveying national experts about “misnaepery,” Education Week explained that NAEP “is widely viewed as the most accurate and reliable yardstick of U.S. students’ academic knowledge … But when it comes to many of the ways the exam’s data are used, researchers have gotten used to gritting their teeth.”

    Also in 2013, James Heckman, a Nobel Prize laureate who lived in Oklahoma City as a child, warned of the dangers of misusing test data. In 2025, Heckman and his co-author, Alison Baulos, published “Instead of Panicking over Test Scores, Let’s Rethink How We Measure Learning and Student Success.” They urge us to “pause some tests and redirect resources toward more meaningful ways to promote and assess student learning.”

    They don’t oppose the use of tests as one measure when used for diagnostic purposes; those metrics “may be valuable for tracking large-scale trends — such as monitoring recovery from the COVID-19 pandemic.” However, “the current overreliance on tests is costly in many ways and is not an effective strategy for improving education as a whole.” And, “standardized tests often conceal more than they reveal.” 

    Getting back to recent headlines, I appreciate the press’ reporting on Ryan Walters’ lack of transparency. I’m even more impressed with their reporting on the lack of evidence to support his claims that his administration has improved outcomes. But they now need to report on the reasons why the Commission made a terrible mistake, apparently based on the alt facts generated by corporate reformers’ false public relations spin.

    Many colleges and universities in California are currently expanding the ways students can receive credit for prior learning, an increasingly popular practice of awarding college credit to students for knowledge they acquired outside a college setting.

    Proponents of granting credit for prior learning, often referred to by its acronym CPL, point out that Advanced Placement or International Baccalaureate tests are very common ways that students receive credit for college classes before they attend college. But there is an effort to broaden the ways that students may be able to receive credit for what they’ve learned outside a college classroom, whether on the job, through volunteering or even a hobby, such as photography or playing an instrument. 

    In the past few weeks, Gov. Gavin Newsom praised the notion of giving credit for prior learning as an important way to recognize the skills that adults pick up in the military or even volunteering through the California Service Corps.

    Many educators say this is an important step toward promoting equity in their institutions. It’s a way to recognize the academic value of work, particularly for students who may have left college to work or started college later in life. Proponents say it can save students time and money, making graduation more likely.

    Does my college or university offer credit for prior learning?

    Because this is an arena of education that is rapidly evolving, it can be difficult for students to figure out whether they may qualify for credit. Right now, that depends on the policies at any given institution or academic department. 

    College advisers or faculty members are a good starting point. Veterans may also want to speak to the department that supports veterans. Many institutions are currently refreshing their policies for giving credit for prior learning and outlining them in their course catalogs.

    How can credit for prior learning help students?

    Students can fulfill general education or major requirements before even showing up to school. This means that they’re able to graduate with a degree or credential more quickly — which also means that they’re more likely to graduate. This can save students time and money.

    A study by the Council for Adult and Experiential Learning found that students who started school with 12 credits could save between $1,500 to $10,500 and nine to 14 months, depending on the institution.

    The study found that 48% of students over 25 years old who had obtained credit for prior learning completed their degree or certificate within 7.5 years, compared with 27% of students who had no credit. The completion rate was even higher, at 73%, for credit received outside the military. 

    There are also important psychological benefits to students who start college with credit under their belts. These students begin their college careers with a sense of momentum and accomplishment, according to Tina Barlolong, career center co-coordinaor at Palomar College in San Marcos. 

    Are there any drawbacks?

    Taking a college course just for the sake of taking a course has risks, and the same is true for pursuing credit for prior learning. It takes a lot less time and money than a full course, but students on financial aid or veterans on the GI Bill, for instance, could run out of funding before they’ve attained a degree if they pursue unnecessary credit.

    Proponents of credit for prior learning encourage students to discuss their best options with a counselor, adviser or a faculty member in a student’s field of study. They can ensure that the credit in question will serve a purpose, such as fulfilling a general education or major requirement.

    What are some common methods of receiving credit for prior learning?

    It may be as simple as passing a challenge test required by a department. The College Board offers a way to test out of college-level material through its College-Level Examination Program, usually referred to as CLEP in the field.

    Portfolio reviews are common in the arts. That means a professor or committee may review paintings, photography or graphic design before deciding to award a student credit. A portfolio could also be used to assess a student’s business skills.

    Playing music or acting out a scene may be a way to earn credit in the performing arts. Beginning piano is a popular course.

    Some students may have obtained a certificate or license in their job that is the equivalent of what they would learn in a college course. Certifications offered by Microsoft or Google that allow students to receive credit for basic computing are common.

    The American Council on Education offers many colleges and universities guidance on how to award credit. That can include deciding whether military or corporate training meets academic standards. 

    Are veterans eligible for credit for what they have learned while in the military?

    Yes. In fact, the study by the Council for Adult and Experiential Learning found that 68% of students who received credit for prior learning earned it through the military.

    Credit for prior learning has a long history among veterans. The military offers service members extensive training that tends to be highly standardized. When they are discharged, veterans receive a Joint Services Transcript, which translates military experiences into civilian language. This can be used for a resume or for receiving college credit. Veterans can also receive credit for college through free examinations called DSST tests.

    Every public university or college in California accepts the Joint Services Transcript — though whether any given course is eligible for credit may depend on the institution or department.

    Veterans may be able to get credit for physical education requirements, for instance. Depending on their training in the service, veterans may also receive credit for courses in engineering, law enforcement, computer science or health care.

    One branch of the military bypasses this whole process: the Air Force has its own community college, so most of its members simply receive a college transcript upon being discharged.

    Can I get credit for work experience?

    Not exactly. The idea behind getting credit for prior learning is that it is awarded for learning and skills acquired, not just for work experience. 

    Someone working as an auto mechanic might have picked up a lot of knowledge and skills, but that experience may not correspond to everything covered in an automotive repair course, such as safety procedures, ethics and professionalism. Credit is granted for that knowledge and training — not just the years working in a given field.

    How do California’s colleges and universities view credit for prior learning?

    Thanks to legislation, community colleges and the campuses of California State University and the University of California all have policies on the books for credit for prior learning. But how those policies are implemented varies from system to system, school to school and even department to department.

    All three systems will consider the veterans’ Joint Services Transcript and offer credit for any equivalent courses that are offered on their campus. 

    California’s community colleges have perhaps the most generous guidelines for awarding these credits. Colleges may award credit for skills learned through work experience, employer-training programs, military service, government training, independent study or volunteer work.

    The community colleges have set an ambitious goal of ensuring that at least 250,000 Californians receive credit for prior learning by 2030. The Mapping Articulated Pathways Initiative supports community colleges in these efforts through training, technology and policy.

    California State University overhauled its policies for granting credit for prior learning in 2023, and it has required each campus to have its own policies. The system does accept exams such as the CLEP and DSST for credit. It will also accept any training or instruction that corresponds to American Council on Education guidelines.

    The University of California has the strictest guidelines on credit for prior learning. Its guidance states that credit will only be offered for courses that meet the same high standards of the UC system — this stance is typical of selective universities. It does not award credit for vocational or technical training or for results on CLEP or DSST tests. It will accept credit for courses on veterans’ Joint Services Transcript for any equivalent courses UC offers.

    “The more traditional, the more selective an institution is, the more they tend to not have generous policies,” said Su Jin Jez, CEO of the nonprofit California Competes, a nonpartisan policy and research organization.

    How much does getting this credit cost?

    This is another factor that varies by institution. It might be free for students who have already matriculated. Many institutions charge a fee for tests or other assessments. Some might charge for each credit unit. Generally, it will be considerably cheaper than tuition. However, funding can become a barrier when financial aid does not cover these fees, according to a recent survey by the American Council on Education.

    Will this credit transfer from one institution to another?

    Theoretically, it should, just like any other course. When a student receives credit for prior learning through an institution, their transcript will show that they received credit for a specific course number. 

    But no matter how a student earns credit, transferring credits can be potentially tricky. It largely depends on the institution or major a student is transferring into.

    Does giving credit to students for prior learning end up hurting college enrollment?

    It may sound counterintuitive, but giving credit to a student for prior learning actually means it is more likely that the student will take more courses. The Council for Adult and Experiential Learning study found that students awarded credit for prior learning actually tended to earn 17.6 traditional course credits more than students without those credits.

    Yes, he’s moving to dismantle the Department of Education, and yes, he’s trying to restrict what schools can teach about race. But the most dangerous attack on the horizon isn’t coming from the president, it’s coming from the Supreme Court.

    This is a particularly disheartening reality because the Supreme Court has often been one of public education’s greatest champions. As far back as 1954, in Brown v. Board of Education, the court described public schooling as “the very foundation of good citizenship” and the “most important function of state and local governments.” Just four years ago, in an 8-1 opinion involving a Snapchatting cheerleader, the court proudly declared that “Public schools are the nurseries of democracy.”

    Later this month, however, the court will hear oral argument in a pair of cases with the potential to radically destabilize public schools as we know them. And there is reason to be deeply worried about how the conservative majority will rule.

    The first case, Oklahoma Statewide Charter School Board v. Drummond, poses the question of whether the 46 states with charter schools must offer public funds to schools that would teach religious doctrine as truth. The second case, Mahmoud v. Taylor, involves the claim that religious parents should have a right to opt their children out of controversial public school curricula.

    Takentogether, Drummond and Mahmoud threaten the twin cornerstones of the American education system that Brown affirmed six decades ago: Since Brown, America’s public schools have operated under a norm of inclusive enrollment, and they’ve offered all children a shared curriculum that reflects the values that communities believe are essential for civic participation and economic success.

    If the court tears down these foundational norms, the schools that remain in their wake will be a shell of the democracy-promoting institution the court itself has long lionized — and that healthy majorities of parents continue to support in their local neighborhoods. And although there’s a way to avoid the worst outcome in both cases, the path ahead is uncertain: It will require the court to follow history in an evenhanded manner (in Drummond) and progressives to accept a middle ground (in Mahmoud).

    The legal challenges presented in Drummond and Mahmoud did not arise out of thin air. They are part of a long-term conservative movement strategy aimed at eroding public education.

    A major component of this strategy has been a consistent call to fund school choice, a broad umbrella term that encompasses various programs such as school vouchers and educational savings accounts that channel taxpayer dollars away from traditional public schools and into private ones. Drummond’s call for a constitutional right to taxpayer-funded religious education can thus be thought of as a major front in Project 2025’s “core principle” of “significantly advanc[ing] education choice.”

    Conservatives have likewise sought to brand public schools as purveyors of “woke” ideology rather than facilitators of a shared set of community values. The claim at issue in Mahmoud — a parental right to opt out of curricular choices that some find religiously objectionable — is accordingly another salvo in the broader culture wars, and one in which conservatives are asking the court to grant them a legal trump card.

    Ultimately, to a significant cross-section of the Republican Party, public schools are now the “radical, anti-American” enemy. And viewed from that perspective, Drummond and Mahmoud may represent the greatest chance for delivering a knockout blow.

    Drummond and Inclusive Enrollment

    Technically, the Drummond case is just about Oklahoma. That’s because it arose out of Oklahoma’s refusal to fund a religious charter school named the St. Isidore of Seville Catholic Virtual School. (According to St. Isidore’s handbook, “the traditions and teachings of the Catholic Church and the virtue of Christian living permeate the school day.”)

    But make no mistake: It is blue states that have the most to lose in this case. For if St. Isidore has a right to public funding in Oklahoma, that same right would exist for religious charter schools in California and New York — places where, until now, taxpayer funds have never been used to teach religion as truth to K-12 students.

    It is hard to overstate how big a sea change this would be. Nonreligious charter schools currently receive more than $26 billion in public funds and educate some four million children. So a ruling in favor of religious charter schools could mean billions of dollars for religious education — a prospect that one Catholic school executive called “game-changing” for how it would enable religious schools to “grow [their] network.”

    But the implications are far more than monetary. They strike at the very vision of public schools as places where children come together from all walks of life to learn what the Supreme Court once called the “values on which our society rests.” Bankrolled by taxpayer dollars, Drummond would transform the American education system into a taxpayer-funded mechanism for transmitting each family’s preferred religious tenets.

    What is more, religious charter schools will likely argue that they have a further Free Exercise right to restrict enrollment only to adherents of their particular faith (indeed, a religious private school in Maine has already advanced this claim). At the end of that argument is a publicly funded K-12 education system that tribalizes the American people at a time when we need to be doing exactly the opposite: forging bonds of connection across our differences.

    Justice Thurgood Marshall once cautioned that “unless our children begin to learn together, there is little hope that our people will ever learn to live together.” If the court rules for the religious charter schools in Drummond, we will come one giant — and regrettable — step closer to the world Marshall feared.

    Mahmoud and the Attack on Curriculum

    The Mahmoud case emerged out of a 2022 Montgomery County, Maryland, school board policy that introduced a new set of LGBTQ-inclusive storybooks into its pre-K through 12th-grade language arts curriculum. In general, the books aimed at instilling respect and civility for people from different backgrounds. In practice, though, the books led to controversy. One of the books, entitled Pride Puppy, was directed at pre-K students and invited students to search for images of a lip ring and a drag queen.

    Montgomery County initially permitted parents to opt their children out of reading these new books. But the district soon changed course, which is what led the Mahmoud family to sue. Their argument was that the Free Exercise Clause grants parents like them the “right to opt their children out of public school instruction that would substantially interfere with their religious development.”

    This is a truly difficult case, even for someone who, like me, holds an unyielding commitment to ensuring that all LGBTQ students feel safe at school. But one can hold that commitment while also acknowledging that the choice to force children as young as five years old to read books like Pride Puppy over their parents’ objection is not an obvious one. Indeed, Montgomery County has since removed Pride Puppy from its curriculum — a reasonable concession.

    The great danger in this case, though, is not about the parental right to opt 5- and 6-year-olds out of controversial curricula. It’s that a decision recognizing a parental opt-out right would be difficult to contain via a sensible limiting principle. Would parents of middle or high school children enjoy a similar right to opt their children out of any assignment or reading that espouses support for LGBTQ rights? How about a right to opt out of science classes that teach biology or evolution? And what of history classes that some religious parents may find too secular for their liking?

    In all of those contexts, lower federal courts had unanimously rejected the contention that simply because a parent finds something to be religiously objectionable, they can excuse their child from a shared curricular goal. Mahmoud could upend that settled consensus and replace it with a world in which public schools are forced to offer bespoke curricula to all different families based on their particular religious commitments.

    That’s a recipe for an education system that would certainly teach some values to our children. But this much is for sure: They would no longer be shared ones.

    How to Save Public Education at the Court

    The plaintiffs in both Drummond and Mahmoud may be optimistic that the 6-3 conservative supermajority will side with them. After all, religious litigants have fared remarkably well at the Supreme Court of late.

    But a surprising obstacle exists in the Drummond case — and Maryland officials, if they are smart, may yet have the final word in Mahmoud.

    In Drummond, the best argument against the claimed Free Exercise right to taxpayer-funded religious schools comes from the very place that the conservative Supreme Court has lately looked to move the law right on abortion and guns: history and tradition.

    As Ethan Hutt, a leading historian of education, and I show in a forthcoming paper, it turns out the denial of funding that St. Isidore complains of today is something that happened routinely during the founding era. Yet no one — no parent, no religious leader, not even a religious school that was denied funds on equal terms with its nonsectarian counterparts — ever filed a lawsuit (much less won one) arguing that the right to Free Exercise demanded otherwise.

    This is precisely the historic pattern that the Supreme Court relied on to reject the right to abortion in Dobbs: “When legislators began to [ban abortion in the 19th century], no one, as far as we are aware, argued that [they had] violated a fundamental right.”

    If the absence of legal contestation in the face of government action 200 years ago shows that the Constitution’s original meaning does not encompass a claimed right to abortion, it’s hard to see why that logic should differ when the claimed right involves religious school funding. Put simply, the court can be consistently originalist, or it can recognize the religious charter school funding right claimed in Drummond. But it can’t do both.

    The legal argument to protect public education is less clear in Mahmoud. But in that case, there is another way to steer clear of a Supreme Court ruling that would imperil evolution, biology, history and LGBTQ-inclusive lessons in the upper grades: Maryland officials can override the Montgomery County policy and extend an opt-out choice to parents of young children like the Mahmouds.

    There would be clear precedent for such an action by the state. After New York officials took a similar step to eliminate a policy dispute in a major gun case in 2020, the court dismissed that case as moot — putting off a dangerous ruling for at least the time being.

    Of course, doing so would require lawmakers in Maryland to accept parents of young children choosing to withdraw their children from reading controversial LGBTQ-inclusive books. But perhaps lawmakers can see a principled distinction between the desire to make schools a safe space for LGBTQ children — a nonnegotiable, core value — and the desire to use elementary school classrooms as a tool for changing hearts and minds on controversial topics more generally.

    In truth, progressives were probably never going to win that battle in kindergarten classrooms, especially with the present political climate. Progress on social attitudes concerning the transgender community was always more likely through the same mechanisms that produced rapid change for the gay and lesbian community — mainstream media, social media and the critical realization that our friends, family and other loved ones are members of these different communities and deserve equal respect.


    In the end, the Supreme Court may choose simply to ignore history and tradition in Drummond, where it is inconvenient for a movement conservative cause. And a policy change in Maryland could simply delay the inevitable, as new cases could always be brought advancing

    The bigger takeaway, then, is about the war against public education and its likely toll. Public schools were a major part of what made America great. So in seeking public education’s demise, the Drummond and Mahmoud cases could portend staggering consequences: less social tolerance, reduced international competitiveness and continued inequality along economic and racial lines.

    But the greatest cost may be for our democracy. After all, the Supreme Court reminded us just four short years ago that public schools are where our democracy is cultivated. That’s why the timing of these cases could not be any worse. In a moment when American democracy is being tested like never before, the court should be the last institution — not the leading one — to dismantle our public schools.
